Ohio expects charities to register and stay current. Before your nonprofit solicits contributions in the state, it generally must register with the Ohio Attorney General’s Charitable Law Section, regardless of your tax-exempt status. From there, you file an annual report with the Attorney General, due by the 15th day of the fifth month after your fiscal year ends. The office accepts your IRS Form 990 to satisfy much of that report, but the underlying numbers, including your statement of functional expenses, still have to be accurate and complete. Miss the deadline and Ohio charges late fees, so the reporting cannot slide. Ohio nonprofits also file a Statement of Continued Existence with the Secretary of State every five years to stay in good standing. Your sales tax exemption is separate again, and it only holds when your organization keeps the right exemption documentation on file.
